EXAMINATION OF CONSTITUTIONALITY OF CHILD PROTECTION LAW IN FIQH

The child protection law provides its own interpretation, which is part of the law of children in Indonesia starting from civil rights, parenting, guardianship, adoption, exploitation of children in the economic, social and sexual fields. On the other hand, the punishment for adults that committing crimes on children are the responsibility of parents, the community and the state in protecting children. However, the legal coverage of the child is very broad and cannot be simplified into the field of legal violations committed by children. Due to the number of child protection regulations, it is necessary to compile legislation by state agencies that have authority. A study is also needed to see the harmonization between legislation in Islamic law (Fiqh). Thus, there can be seen gaps and legal vacancies that occur. Therefore, it is necessary to carry out legal reform so that the issue and protection of children becomes a priority by the state.Downloads
