SETTLEMENT OF OVERLAPPING LAND RIGHTS CERTIFICATE DISPUTES (Case Study of Use Right Certificate Number 18 On Behalf of the Local Government of Tanah Datar Regency with Property Right Certificate Number 855 On Behalf of Sien Erli Sianti and Regina Simon)

This study examines and analyzes the causes of overlapping certificates, efforts to resolve disputes over overlapping certificates, and the legal certainty of overlapping certificates of land rights. uses empirical juridical methods, primary data collection or processing techniques, and interviews with relevant informants. Overlapping Certificates can occur due to administrative defects and/or juridical defects so that legal products can be canceled, this is based on Article 35 of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases. From the results of the study in the case of Overlapping Use Rights Certificates Number 18 on behalf of the Regional Government with Property Rights Certificates Number 855 on behalf of Sien Erli Sianti and Regina Simon, several factors led to overlapping, one of which was due to administrative defects where there were errors when carrying out certification in the field. In this case, it is necessary to make non-litigation settlement efforts, namely through mediation carried out by the National Land Agency of Tanah Datar Regency as the Agency which has the authority to issue certificates of land rights because mediation settlement efforts carried out are still not optimally carried out by the agency concerned. In addition, to guarantee legal certainty for owners of certificates of land rights that have been legally obtained, the settlement of overlapping disputes between usufructuary rights number 18 and property rights number 855 needs to be implemented immediately.References
