THE AMBIGUITY OF TABARRU' AND TIJARI CONTRACTS ON PAGANG GADAI IN MINANGKABAU (STUDY IN NAGARI PADANG TALOK, AGAM DISTRICT)

The results of this research found several things: First, the form of the contract in the Pagang pawn transaction in Nagari Padang Tarok is in the form of a tijari contract because in this contract a profit or profit is also expected. However, the initial motive for this contract to occur was a form of mutual help, because this contract was initiated by a request from the pawnbroker so that the apprentice would be willing to accept the pawning of his rice field, while on the part of the apprentice there was also a feeling of wanting to spare other people when he was pawning the rice field and after the transaction. which is carried out in the form of additions (deepening) to the loan value from Pagang gadai. Second, the factors causing the occurrence of pawnshops in Nagari Padang Tarok are in order to meet the various economic needs of pawnshops such as children's school fees, household needs and house construction. These things apply to pagang assets in the form of low-level pusako assets or joint ownership assets. Meanwhile, if the pawn object is in the form of high pusako property, then there are only 4 (four) reasons that allow the land to be pawned, namely the gadang katirisan house, the gadih gadang alun balaki, the mayik tabujua in the middle of the house, and the mambangkik Batang tarandam. Third, taking advantage of the practice of Pagang gadai in Minangkabau is permitted according to the opinion which states that the pagang pawn contract is essentially the same as the bay' al-wafa' contract (purchase sale and purchase) even though it has different names in various regions.
