RESISTANCE TO CUSTOMARY SANCTIONS OF MARRIAGE IN NAGARI BALIMBING IN THE PERSPECTIVE OF ISLAMIC LAW

This research aims to find out the reasons why the community rejects customary sanctions for marriage in Nagari Balimbing and the views of Islamic law regarding resistance to customary sanctions for marriage in Nagari Balimbing. Based on field research, this study found that the traditional marriage rules in Nagari Balimbing were rejected by several people. The first reason is that the mamak's duties should be stated in the proverb, but in this case, the niniak mamak seems to be complicating traditional wedding traditions. Second, according to Niniak Mamak, these customary rules were created so that strong ties of relationship could be established, thereby creating a high level of social community among the people of Nagari Balimbing. Third, the traditional regulations of Nagari Balimbing are not achieved because they cause disaster. Based on 'urf, if it is related to the customary rules of the Selingka Nagari Balimbing, it is natural for the community to reject the customary rules set by the Niniak Mamak because they bring harm, and this includes 'urf fasid.Referensi
